[目的/意义]专利蟑螂(Patent Troll)属于非专利实施体(Non-Practicing Entities,NPEs)的一种。随时间推移,中国将是专利蟑螂的理想之地,这将对中国创新活动和知识产权有效保护会带来较大不利影响,正确识别专利蟑螂具有重要意义。[方法/过程]为厘清这一问题,该文运用美国专利诉讼资料,将原告专利所有人分为七类,运用Logistic回归模型,实证考察原告类型、专利质量以及MLPs对诉讼和解率的影响来回应这一问题。[结果/结论]研究发现:不同类型NPEs的专利质量及其对和解率的影响并不相同:大学、前新创公司、专利授权公司及技术研发公司发起的诉讼案中,专利质量提升对和解率有正向显著影响;个体、大型专利整合者的专利质量对和解率影响则相反;一般而言,MLPs占诉讼案专利的比例越高,和解率越低;不过在个体发明者及专利授权公司发起的诉讼案中,则有和解率较高的趋势。由此推断个体发明者及专利授权公司等NPEs类别更符合专利蟑螂的特征界定。最后给出了相关政策及建议。

[Purpose/Significance]Patent troll belong to Non-Practicing Entities(NPEs).Over time,China will become the ideal place for patent trolls,which will have a great adverse impact on China's innovation activities and effective protection of intellectual property rights.Therefore,patent trolls must be correctly identified,prevented and distinguished from other NPEs types.[Method/Process]In order to clarify and solve this problem,this paper uses the patent litigation data of the United States and divides the plaintiff patent owners into seven categories,and uses Logistic regression model to empirically investigate the impact of plaintiff types,patent quality and MLPs on litigation settlement rate.[Result/Conclusion]The results show that:the patent quality of different types of NPEs and its impact on the settlement rate are not the same:in the lawsuits initiated by universities,former start-up companies,patent licensing companies and technology research and development companies,patent quality improvement has a positive and significant impact on the settlement rate; The patent quality of individual and large patent integrators has an opposite effect on the reconciliation rate.Generally speaking,the higher the proportion of MLPs in litigation patents,the lower the settlement rate; However,in the lawsuits initiated by individual inventors and patent licensing companies,the settlement rate tends to be higher.From this,it can be inferred that NPEs categories such as individual inventors and patent licensing companies are more in line with the characteristics definition of patent trolls.At last,some policy suggestions are given.
